1. Agreement to Terms

By accessing or using AI Product Pix ("Service," "we," "our," or "us") at aiproductpix.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and AI Product Pix.

2. Description of Service

AI Product Pix is an AI-powered service that generates professional product photography from user-uploaded images. Our Service:

• Processes product images using Google Gemini AI technology
• Generates four (4) professional photo variations per transaction
• Provides high-resolution images for download immediately after generation
• Charges a one-time fee of $1.99 per generation request
• Does not store your original or generated images on our servers

3. Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you are using the Service on behalf of a business or entity, you represent that you have the authority to bind that entity to these Terms.

4. User Accounts and Payment

4.1 Payment

All payments are processed securely through Stripe. By making a payment, you agree to provide accurate and complete payment information. The current price is $1.99 per generation (4 photos). Prices are subject to change, but any changes will not affect transactions already completed.

4.2 Payment Authorization

By providing payment information, you authorize us to charge the applicable fees to your payment method. You agree to pay all fees and applicable taxes incurred by you or anyone using your account.

4.3 No Recurring Charges

Our Service operates on a pay-per-use basis. There are no subscription fees or recurring charges. Each transaction is a separate, one-time purchase.

5. Acceptable Use Policy

5.1 Permitted Use

You may use the Service to:

• Generate professional product photos for legitimate commercial or personal use
• Upload images of products you own or have rights to photograph
• Download and use generated photos for e-commerce, marketing, and promotional purposes

5.2 Prohibited Use

You agree NOT to:

• Upload images containing illegal content, copyrighted material you don't own, or content that violates third-party rights
• Upload images containing nudity, violence, hate speech, or offensive content
• Upload images of people without their consent or images that violate privacy rights
• Use the Service to create misleading, deceptive, or fraudulent content
• Attempt to reverse engineer, decompile, or extract the underlying AI models
• Use automated systems (bots, scripts) to access the Service without authorization
• Resell or redistribute the Service without explicit written permission
• Use the Service in any way that could damage, disable, or impair our systems
• Violate any applicable local, state, national, or international law

6. Intellectual Property Rights

6.1 Your Content

You retain all ownership rights to the images you upload ("Your Content"). By uploading images, you grant us a limited, temporary license to process your images through our AI service solely for the purpose of generating professional photos. We do not claim ownership of your uploaded images or the generated photos.

6.2 Generated Photos

Once generated, the professional photos are yours to use for any legal purpose. We do not retain copies of generated photos and cannot provide them again if you lose them. You are responsible for downloading and saving your generated photos.

6.3 Our Service

The Service, including its original content, features, and functionality, is owned by AI Product Pix and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.4 Representation and Warranty

You represent and warrant that you own or have the necessary rights to upload and process the images you submit, and that your use of the Service does not infringe on the intellectual property rights of any third party.

7. Service Availability and Modifications

7.1 Service Availability

We strive to provide reliable Service, but we do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. We may need to suspend the Service for maintenance, updates, or other reasons.

7.2 Modifications to Service

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice. We may also impose limits on certain features or restrict access to parts or all of the Service.

7.3 AI Limitations

Our Service uses AI technology, which may not always produce perfect results. Generated photos may vary in quality and may not always meet your expectations. We do not guarantee specific results from any generation request.

Due to the instant nature of our Service and the immediate delivery of digital products, all sales are final. Please review our separate Refund Policy for complete details on refunds and exceptional circumstances.

9. Disclaimers and Limitations of Liability

9.1 "AS IS" and "AS AVAILABLE"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

9.2 No Guarantee of Results

We do not warrant that the Service will meet your requirements, be uninterrupted, timely, secure, or error-free, or that the generated photos will be of satisfactory quality for your specific purposes.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI PRODUCT PIX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST 12 MONTHS, OR $1.99, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless AI Product Pix, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) any content you upload to the Service.

11. Dispute Resolution and Governing Law

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which AI Product Pix operates, without regard to its conflict of law provisions.

11.2 Informal Resolution

Before filing a claim, you agree to contact us at support@aiproductpix.com to attempt to resolve the dispute informally.

11.3 Arbitration

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the United States. You agree to waive your right to a jury trial or to participate in a class action.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Third-Party Services

Our Service uses third-party services including Google Gemini AI for image processing and Stripe for payment processing. Your use of these services may be subject to their respective terms of service and privacy policies. We are not responsible for the actions, content, or services of third parties.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last Updated" date. 16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

17. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and AI Product Pix regarding the Service and supersede all prior agreements and understandings, whether written or oral.
